Chandigarh, June 15: Haryana Cabinet which met under the Chairmanship of Chief Minister, Sh. Manohar Lal here today approved the proposal of reconstituting the Motor Vehicles Department by giving powers of challaning and compounding to further strengthen the process of checking by the enforcement agencies and the provisions of the Motor Vehicles Act to be enforced more effectively in the state. This will create more deterrence and improve road safety.
Under the new Rules amended vide Haryana Motor Vehicles (Amendments) Rules 2021 the officers namely Transport Commissioner, Haryana, Director General/Director, State Transport, Haryana, Deputy Commissioner of the District, Superintendent of Police, Additional Deputy Commissioners, Additional/Joint State Transport Commissioner, Additional/Joint Director, State Transport, Secretary, Regional Transport Authority, Sub Divisional Officer (Civil)-cum-Registering Authority (Motors), City Magistrate, General Manager, Haryana Roadways, Flying Squad Officer, Traffic Manager, Motor Vehicle Officer (Enforcement), Motor Vehicle Inspector (Enforcement), Assistant Secretary, Regional Transport Authority and Police Officer not below the rank of ASI have been appointed as the officers of Motor Vehicles Department.
These officers of the Motor Vehicles Department shall exercise the powers of challaning for various traffic offences.
As per the Haryana Motor Vehicles (Amendments) Rules 2021 the Challaning officers of The Police Department of and above the rank of ASI will also be deemed to be challaning officer outside Municipal Cities and Towns pertaining to the offence committed under the sections mentioned in the said Act.
The framing of the new Haryana Motor Vehicles (Amendments) Rules 2021 has been done as now, the Central Government has amended the Motor Vehicles Act, 1988 (Principal Act) vide the Motor Vehicles (Amendment) Act, 2019 as notified on August 9, 2019 and inserted additional offences and also enhanced the amount of fine/penalties for existing offences.
It has accordingly been felt appropriate to reappoint the officers of Motor Vehicles Department under rule 225 of the 1993 Rules and to grant challaning powers to the officers so appointed under rule 226 of the said Rules.
